Alleged arson attacks on indigenous minority villages at CHT, Bangladesh

On 20 April 2008 at mid-night an arson attack was made by newly infiltrated Bengali settlers with the direct support of Bangladesh military forces at Baghaihat area of Sajek union under Baghichati upazila in Rangamati district in CHT.
In this attack, around 76 houses of indigenous Jumma villagers of 7 villages were completely burnt down. It is report that Selim Bahari, President of Baghaichari branch and Golam Molla, President of Baghaihat branch of Equal Rights Movement, an extreme nationalist and fanatic organisation of Bengali settler led the Bengali settlers to conduct this attack with the direct sup[port of military forces of Baghaihat army zone of 33 East Bengali Regiment (2) led by commanding officer Lt. Col. Sajid Imtiaz, Captain Zabaedur Rahman and RP Habilder Harun.
The following list of indigenous Jumma villagers whose houses were burnt down prepared by three members of Sajek union, namely, Kalachoga Chakma, Swapanika Chakma and Jotsna Chakma are as follows:

Supayan Chakma's quest for relatives
One-night incident has changed the life of Supayan Chakma, a student of grade VI of Baghaihat High School. He along with a bag and a bundle of books was looking for his family members for six days. He was crossing one hill to another hill of deep forest. But he could not trace out his family members.Kamini Chakma of Daine Baibachara village of Sajek union is the father of Supayan Chakma. Like other houses, their house was also burnt to ashes during the arson attack committed by some miscreants on 20 April. He became detached from his father, mother and his elder brother Biken Chakma while they escaping.Supayan Chakma who reached at Kabakhali moan (hill) under Dighinala upazila last Saturday said that he would go Babuchari union close to Indian border to find out his parent. Some one informed him that his father, mother and brother took shelter at a hill there.Supayan Chakma, like other villagers, started walking for safe shelter along with his books and cloths. After walking a long distance along with the villagers, they halted for rest at a place. But he became aware suddenly that his father, mother and brother are not along with. He passed nights sleeping at bottom of tree or at house of different families even without food and started every day tracing for his family members during daytime.The sun was simmering while he started walking 10 kilometres distance along with his books and bag. However, could he find out his family members?During arson attack by some miscreants at Baghaihat area of Sajek union under Baghaichari upazila in Rangamati district at night of 20 April, more than hundred houses of Jumma and Bengali peoples of seven villages were burnt to ashes. Of them, most of Jumma villagers took shelter in deep forest while other Jummas at a Buddhist temple and a cluster village. And Bengali people took shelter at Bghaihat bazar. Though one week have been passed after occurrence of the incident, but commander of the Baghaihat zone admitted that situation is yet to be normal.Baghaichari Unpazila Nirbahi Officer Mr. Shibir Bichitra Barua admitted that more than two hundred students' books were burnt down in this arson attack. He said that the books for these students would be bought for continuing their study without interruption.

A MINOR HINDU MINORITY GIRL ABDUCTED IN DINAJPUR, BANGLADESH

Note: Till writing this report, Police found to be prejudiced and reluctant to apprehend the criminal. Our Bangladesh National Chapter reported that criminals are in close contacts with IO (Investigating Officer). However, police denies of any such link.
Due to continuous threat from the influential quarters, Shri Chanchal Dutta (45), hapless father of a Hindu schoolgirl couldn't file a case against the kidnappers of his daughter at the local police station for four days. Nobody is speaking out against this crime fearing retribution, as the kidnapper come from a very notorius family. Finding no other alternatives, Chanchal Dutta approached HRCBM-BNC, Dinajpur for justice.
As per Shri Chanchal Dutta of Barabandar under Kotwali PS of Dinajpur, his minor aged daughter Miss Upama Dutta (15) is a student of class IX in the local school, was going to her tutor's residence on 26th April at around 7-30 A M, when she was proceeding towards her tutor Shri Tapan Chakraborty's residence, she was abducted by a neighborhood hoodlum on the road, Sohel Chowdhury, son of Alamgir Chowdhury alias Dulal Miah, a local man of Baluchar of Dinajpur . He used a motor vehicle to abduct her. Two local young men were the accomplices of this incident.
When Chanchal Dutta apprised earlier Alamgir Chowdhury and their relatives regarding unbecoming behaviour of Sohel in the street .They did not recognized this untoward incidences.
. Chanchal Dutta filed FIR on 26th April ,the same day to the Local Kotwali Thana, but Officer in Charge Mr Matiur Rahman ( 88-01713373963 ) did not take his case. Subsequently, Shri Dutta again brought this incident to the notice of the guardians of the abductor and other villagers but to no effect.
Shri Dutta apprised the case to the HRCBM- Dinajpur Unit , and HRCBM men talked with the SP of Dinajpur Mostafa Kamal ( Tel : 88- 01716386246 and 88-01713373955) and OC Kotwali but could find a positive reply from them besides tall talks . HRCBM apprised me that after 4-days police took FIR on 1 May 2008 . , FIR No -1 of 1/05/08 under Kotwali PS of Dinajpur.
Vice president of HRCBM-BNC Shri P R Barua ,former DIG ,Police and S R Baroi , Addle DIG, police were informed to take the matter for further enquiry and action. This the fourth case in two months.

Buddha Rattan Bhikkhu, president, IJPN, USA & as many as 15 other monks were present at the rally and talked about CHT & minority problems.... One monk from Tibbet joined the gathering. Three other monks from Burma respectively Ven Kheminda; U Suriya & Ashin Indaka joined & supported .....demands. ..were: Stop killing in CHT; Stop Land Grabbing; Stop Military atrocity; Implement CHT Peace Treaty; Withdraw Military from CHT; Stop Burning Houses in CHT; Stop Religious Persecution; Repeal Enemy Property etc... Buddha Rattan Bhikkhu, president, IJPN, USA & BHBCUC, USA president Ratan Barua jointly handed over two memorandums. ..to the Secretary General's representative.

Humiliated and oppressed, a minority family of Narsingdi appeal to HRCBM for safety and secuirty

Background: Mr. Lab Chandra Debnath S/O Late Dinesh CH Debn ath of Anandi, PS & Dist - Narsingdi Bangladesh filed an appeal to HRCBM-Bangladesh for security and safety
of his family members. Mr. Lab Debnath is a businessman of Madhabdi Bazar and residing his ancestral home generation after generation over 259 years. In the month of October 2007, one of his daughter Miss Lata Debnath (16) was abducted by a group of extortionists, land grabber and political tout of Narsingdi area namely Shah Alam S/o L Subed Ali ; Md Afzal Hossain S/O Askar Ali ; Khorshed Alam S/o Siddique Miah, accordingly a case was filed in the Narsingdi PS No 05 dated 02-10-2007.

After that Miss Lata was rescued and a case was filed against those miscreants in the “Nari O Shishu Special Court” Case No -05 (10) 07 US 7/30 and 36/08 . Magistrate Fist Class had taken statement under section 22. The accused Shah Alam and gang has been
threatening the Debnath family to withdraw the case since then. Meanwhile on April 09, 2008, absentee accused Shah Alam along with 5 more criminals and political cadres under the patronage of local politician attack Mr. Dhiren Debnath and seriously injured his body severely stabbing victim’s hands, chest, back and shoulders. Another witness Amal Debnath was also injured in the same incident. Mr. Dhiren Debnath is now in the hospital passing his acute critical times. A case was filed on the same day on April 09, 2008 in the Narsingdi PS Vide No 15(04)08 under section 326/307/379/114 CRPC, yet police has not taken any punitive action.

The victim also filed an appeal to the Chief Adviser Office, CTG Vide No 7046 dated 17 April and to the Inspector Genaral of Bangladesh Police separately. However, seemingly appeals yet to produce any favorable action from the respective authority. Disappointed by the inactions of local administration, victim appealed to HRCBM to intervene.

The following is a copy of the appeal (Bengali) received by HRCBM-BNC depicts nature of torutre faimly is undergoing. It is surprising that police and local administration despite being fully aware of the incident, allowing criminals to indulge in violence against the minority family. In this context, HRCBM has filed a writ before Bangladesh high court in 2006. However, despite that favourable rulling Bangladesh government has filed to protect minotires in the country.

Abduction and gang-raped of minority girl at Khetlal, Bangladesh: Punishment for gang-rape of Taka 12,000 - misappropriated arising out of Arbitration by local touts.

Ms. Rekha Barman (14) daughter of Bhabesh Barman @Gopal Barman Khoka of village Alampur, P.S. Khetlal, District-Joypurhat in Bangladesh gang raped on 28.01.2008. The perpetrators are: - (1) Jewel (26) son of Sujjat Ali Kha and (2) Rubel (23) son of Ayub Ali Kha.

Ms. Rekha Barman was abducted on 28th of January, 2008 and confined her in an abandoned house at night and perpetrators (1) Jewel and (2) Rubel raped her one after another whole night and let her free.

Bhabesh Barman @ Gopal did not see her daughter at home and became puzzled and informed the neighbors, but the neighbors – Akimuddin and Matin Kha proposed for mutual arbitration and Arbitration was held at the house of Advocate Helaluddin. All the arbitrators without the knowledge of Bhabesh Barman procured Taka 12,000/- from the rapists and misappropriated. The fateful incident was suppressed by the local touts. Destitute minority victim had been deprived and no justice was meted out to her and her parents.

Bhabesh is a Hindu destitute land-less day labour . He got no landed property to live, he maintains his family with his daughter – Rekha and his wife with scanty income. Sometimes he and the members of his family remain fasting without food because of poverty.

Police came to know the matter later on 4th February, 2008. Numeri Zaman -Upazilla Nirbahi officer and Shafiqul Islam – Superintendent of Police, Joypurhat visited the spot and came to know this unfortunate incident and they directed the police to take case.

Accordingly Bhabest Barman lodged an F.I.R. at Khetlal Police station against those perpetrators on 04.02.2008 being Khetlal P.S. case no. 2 dated 4.2.2008 under section 7(9)/30 of Nari-O-Shishi Nirjatan Ain,2000.

As soon as I got information from the news published in the daily " Samakal " dated 06.02.2008 I wanted to know from S.P. Joypurhat over his telephone No. 01713374077 (Cell) and also O.C. Md. Akmal Hossain. Both and SP and OC confirmed that they are trying to arrest the perpetrators.

The military-controlled interim government's recent move to curb the democratic rights of indigenous communities, as reported in New Age on Saturday, comes as yet another distressing sign of the heavy handed and chauvinistic attitude that this government espouses in relation to rights of ethnic minorities.
The home ministry, in a recent instruction, has decided to discourage intellectuals and eminent personalities from attending functions organised by ethnic minority groups, which they fear draws attention to the routine oppression and negligence that the communities are subjected to, New Age reported. The ministry's instruction also plans to reduce the media coverage that indigenous rights groups and their demands receive, and plans to actively monitor the activities of high profile ethnic minority leaders such as Jyotirindra Bodhipriyo Larma, better known by his nom de guerre Santu Larma.
According to the report, a government agency has come to the conclusion that the ethnic minorities are engaged in propaganda against the interim government, which the agency claims are aimed at tarnishing the country's image. 'Necessary measures should be taken so that the editors, left leaning politicians and eminent personalities do not participate in the programmes,' the agency's report on this issue reads, sent out to the offices of the president, the chief adviser, the home ministry, the inspector general of police and the Dhaka police commissioner. The report takes a critical view of the programmes organised by the indigenous rights groups organised on August 8, 2007 to mark the International Day of the World's Indigenous Peoples, and names eminent citizens such as former bureaucrat Akbar Ali Khan and economist Rehman Sobhan who attended this function. 'They may also give confusing statements highlighting human rights violations by the army and the army-led joint forces,' the report reads, and warns that the rights groups are trying to have the international day observed officially.
The home ministry cites these reports from intelligence agencies in its own instruction that advises state-owned radio and television and other institutions to prevent 'such activities' Predictably, the ministry has denied that any of the instructions in question were sent out, even in the face of documentary evidence to this effect obtained by New Age.
We would like to assert that such an instruction is in violation of the fundamental human rights guaranteed by the constitution, the rights of the ethnic minorities to give voice to their grievances through free speech, and the rights of the media and ordinary citizens to gain full knowledge of the government's actions in their regard. It is a disturbing sign that the government is engaged in a campaign to blank out the voices of certain citizens of this country based on its narrow chauvinistic perception of nationalism. We strongly condemn this disgraceful campaign, and the secrecy in which it is shrouded, and urge the government to restrain from denying fundamental rights of Bangladeshi citizens, whatever their ethnicity may be.--

ACHR Weekly Review: The Army (the de facto government) is actively involved in the ongoing settlement policy. There is no protection under the law: the rule of law in Bangladesh is subverted to political interference, weak institutions and an indifference to human rights. And the history of grave violations of human rights and ongoing arrest and torture and extra-judicial execution of Jumma activists means any protest carries a high risk."On 25 January 2008, indigenous Jumma peoples are scheduled to hold a large religious gathering at Sarnath Arannyo Kuthir, a Buddhist temple at Karallyachari in Khagrachari Hill district of the Chittagong Hill Tracts (CHTs). The Bangladeshi authorities have banned the meeting. It is unclear if the meeting will go ahead. As we upload this Weekly Review, the Deputy Commissioner of Khagrachari district is holding a meeting with the local Jumma elders of Karallyachari to decide the fate of the religious gathering while the Bangladesh army personnel have been seizing the bikes and other vehicles. But if the meeting takes place it is likely that the government will use violence to suppress it.
The government’s actions at the temple are a microcosm of an ongoing and long established State policy to establish a homogenous Bengali Muslim society; a policy that implies the destruction of the identity of the indigenous Jumma peoples through a process of illegal and often violent settlement of the Bengali Muslim settlers. With international community's attention focused on Bangladesh’s parliamentary elections the care-taker government is free to execute the ethnic cleansing policy in the CHTs without external interference. Background to the Sarnath Arannyo Kuthir: The banning of the religious gathering comes as part of a pattern of wider attacks on the religion of the indigenous communities. On 14 January 2008, the Bangladesh Police arrested Reverend Arya Jyoti Bhikkhu, Head Priest of Sarnath Arannyo Kuthir, after a settler, Abdul Majid, son of late Akad Zaman from Karallyachari cluster village, filed a First Information Report (No. 1 of dated 11/1/2008) under sections 143, 447, 379, 427, 506 and 109 of the Bangladesh Penal Code. The complainant accused about 500 indigenous peoples including Rev Aryo Joti Bhikkhu and Late(!) Tumbo Chakma of committing offences of illegal gathering, theft and destruction to private properties.
In reality, it appears that these indigenous Jummas were making temporary houses to accommodate the Buddhist monks and the devotees within the temple premise. On 21 January 2008, the Additional District Magistrate of Khagrachari Mr Manindra Kishor Majumder in a communication (je.pra.kha/je.em/tin-75/2008-63) ordered the Officer-in-Charge of Mahalachari Police Station area to issue show cause on the headmen and Karbaris (traditional village chiefs) of Karallyachari area as to why they had failed to notify the administration about the religious programme. He also ordered that the court examine the land documents of the temple and threatened legal action against the headmen and Karbaris if they failed to provide satisfactory documentation. On 21 January 2008, Bangladesh army personnel prevented local people from constructing a makeshift bridge over the river Chengi at Karallyachari - Paujjyachari area under Mahalchari Police Station.
The bridge was being prepared for the religious programme. Targeting of the Buddhist temples: The events at Sarnath Arannyo Kuthir are not isolated. Across the CHTs, Buddhist temples have been targeted for destruction by the authorities. Indigenous Buddhist Chakmas and Marmas usually live in and around their temples. Once temples are destroyed the area can be more easily cleared for illegal plain settlers.
In August 2007, illegal settlers and the Bangladesh army personnel tried to take over the lands of the Sadhana Tila Buddhist temple of Babuchara area under Dighinala upazila in Khagrachari district. As national and international protest grew, the de-facto ruler of the country General Moeen U Ahmed visited Dighinala on 28 August 2007 and assured locals that the temple will not be destroyed. On 12 September 2007, Khagrachari district authorities banned the “construction of new Mosque, Hindu temple and Buddhist temple” in Mahalchari sub-division without prior permission of the authorities. While the order does not specifically target any religious group, given the long history of well documented evidence of violations against the Jumma peoples the political reality is that the order is targeted at the indigenous peoples and their religion i.e. Buddhism. On 5 November 2007, Major Qamruzzaman, Commander of Babuchara zone, summoned Sneha Moy Chakma and Santosh Jibon Chakma to his camp and ordered them not to use loudspeakers to announce the Katin Chivor Danotsav, the Buddhist festival that follows the end of the rain retreat of Buddhist monks. On 31 December 2007, a group of army personnel led by Captain Sohel, Commander of Shuknachari Indra Singh Karbari Para camp of the Bangladesh Army, demolished Bhujulichuk Kuthir, a Buddhist meditation centre in Lakshmichari Upazila in Khagrachari district. Captain Shohel threatened witnesses on a prior attack that : “We will not tolerate any Buddha house here; we want only Allah's house”. On 17 January 2008, the Commanding Officer of Baghaihat zone in Rangamati district threatened Reverend Dwip Bongshaw Bhikkhu, the Head Priest of Bishwa Moitri Bouddha Vihar at Hazachara village in Baghaihat. The Commanding officer threatened to demolish the temple if the priest did not leave.
The motivation for taking land of the Sadhana Tila Buddhist temple and its surrounding areas is simple: further illegal settlement. Asian Centre for Human Rights (ACHR) is in possession of a letter dated 19 November 2007 issued by Md. Sulut Zaman, Deputy Secretary of the Ministry of Chittagong Hill Tracts Affairs (MoCHTA). It orders the Deputy Commissioner of Khagrachari district to illegally settle 812 families into the lands of the indigenous Jummas at Babuchara area, Baghaichari mouza under Dighinala upazila (sub- district) in Khagrachari district. Land grabbing: There are many other recent incidents of forcible land grabbing. In December 2007, illegal plain settlers led by Md. Wahab from Burighat under Rangamati district forcibly grabbed 25 acres of land belonging to the indigenous Jumma people at Hatimara village under Burighat Mouza in Rangamati district. During March 2007-November 2007, a total of 399.22 acres of land belonging to 133 Jumma individuals and a primary school in 14 villages under four Unions of Mahalchari police station and Khagrachari Sadar police station under Kagrachari district have been illegally and forcibly grabbed by the illegal plain settlers with direct help from the army. [1] At a press conference in Dhaka on 19 January 2008, representatives of the Committee for Protection of Land in Bandarban called upon the government to cancel the ongoing process of acquiring 9,560 acres of land for the purpose of expansion of Ruma Garrison. The government is presently at the final stage of acquiring 9,560 acres of land for the purpose of expansion of Ruma Garrison in three Mouzas of Galenga, Pantola and Sengum under Ruma Upazilla in Bandarban. Out of the total land to be acquired, 1,569.06 acres belong to the indigenous peoples and 4,000 acres belong to the Forest Department. The project will lead to displacement of 4,315 indigenous persons from 644 families. Way back in 1988, a joint study team of Bandarban District Administration and the Bangladesh Military stated that the project would be disastrous for the local indigenous peoples.

Background to the CHTs crisis: The root of the CHTs crisis lies in the policies of the government of Bangladesh which seek to establish homogenous Bengali muslim society. This implies the destruction of the identity of the indigenous Jumma peoples. 'Jumma' is the collective name for the eleven tribes of the CHTs. Over the last 50 years, hundreds of thousands of Bengali settlers have been moved onto Jumma land. Successive regimes in East Pakistan, and later Bangladesh have supported the influx of Bengali-speaking Muslim migrants into the 5,000 sq km Hill Tracts, which is sparsely populated in comparison to the rest of the country. The settlement has been carried out with varying degrees of violence, including in earlier periods massacre. Today, as a result of the aggressive settlement policy, the Chittagong Hill Tracts has a population of 900,000 which is evenly divided between Muslim homesteaders and the indigenous Jummas. On 2 December 1997, the government of Bangladesh and the Jummas signed a peace accord that brought an end to the long running insurgency. It committed the government to removing military camps from the region and to ending the illegal occupation of Jumma land by settlers and the army.
Since emergency rule was declared in Bangladesh in January 2007, arrests, torture and extrajudicial killings of Jummas have escalated. Jumma activists have been targeted by the Bangladesh military taking advantage of the emergency. Since the declaration of Emergency on 11 January 2007, at least 50 Jumma activists have been arrested, including 20 members of Parbatya Chattagram Jana Sanghati Samity ( PCJSS) and 10 members of United People's Democratic Front (UPDF). False cases such as extortion, kidnapping, murder etc have been lodged against arrested jumma activists. During raids, the Bangladesh military plant arms and ammunitions and claim to have recovered the same from the houses of the indigenous activists to provide grounds for arrest. Most cases have been filed under Section 16(b) of the Emergency Power Rules of 2007 which denies release on bail to the accused during the enquiry, investigation and trial of the case. Prospects: The state has been carrying out illegal land grabbing in CHT since independence. There should be no doubt about the central government’s long term intentions in the CHT. The deliberate destruction of religious centres and intimidation of the priests is part of the political strategy to realize the aim. The Army (the de facto government) is actively involved in the ongoing settlement policy. There is no protection under the law: the rule of law in Bangladesh is subverted to political interference, weak institutions and an indifference to human rights. And the history of grave violations of human rights and ongoing arrest and torture and extra-judicial execution of Jumma activists means any protest carries a high risk. Jumma culture centres around the religion and the community derives a sense of protection from the religion. Attacking the religion is intended to dissipate Jumma communities. The attacks facilitate a climate of fear that undermines what remains of any organized peaceful resistance to the settlement policy. The international community: Despite the increasing rate of illegal settlement and blatant human rights violations, international concern is hard to discern. Even Human Rights Watch and Amnesty International omitted reference to the CHTs in their Annual reports 2007. In more ways than one, international community is responsible for the gradual extinction of indigenous Jumma peoples in Bangladesh. They had funded the programmes for implantation of plain settlers into the CHTs. While speaking about peace in the CHTs, they continue to remain mute witness as the government of Bangladesh continues to provide free rations only to the illegal plain settlers. The failure to condemn state sponsored racism has given a free hand to the authorities in Dhaka to take measures that will eventually destroy the identity of the indigenous Jumma peoples.

This was revealed by Dhaka-based human rights group, the Hill Watch Human Rights Forum after conducting a fact-finding investigation in November 2007.
